                   	     ORDINANCE NO. 9797
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN UNNAMED
                   STREET LOCATED SOUTHEAST OF JENKINS ROAD,
                   SOUTHWEST OF SHALLOWFORD ROAD, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an unnamed street located southeast of Jenkins 
Road,
         southwest of Shallowford Road, more particularly described 
herein,
         and as shown on plat attached hereto and made a part hereof by
         reference:
                Part of an unnamed 40 foot wide right-of-way.  To
                find the true point of beginning of said part of
                street, start on the southeast line of Jenkins Road
                some 2226.35 feet southwest of the intersection of
                the southeast line of Jenkins Road with the
                southwest line of Shallowford Road, said point
                being the southwest corner of lot 1, Brittain's
                Subdivision, as shown by plat of record in plat
                book 33, page 221, R.O.H.C., thence southeast some
                1435.58 feet with the southwest line of said lot 1,
                and said line extended southeastwardly, to the true
                point of beginning, thence continuing southeast
                some 797.7 feet, thence southwest 40 feet, thence
                northwest some 797.7 feet, thence northeast 40 feet
                to the true point of beginning.  Tax Map No.
                1490-G-4.1, 4.2, 4.3, and 6.1.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
               
                1. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer.
               
                2. The affected lots of this abandonment should be
                   resubdivided.
               
                3. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                4. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
